Terms of Service
Effective October 25, 2026
These Terms are an agreement between CostingPlus.com Inc. ("we", "us") and the business that signs up for LawnClock (the "Company", "you"). They cover the LawnClock website at lawnclock.com and the LawnClock mobile apps (together, the "Service"). The person who creates the account confirms that they're authorized to accept these Terms for the Company. Workers who sign in to the Service under a Company's account must also follow these Terms, as far as they apply to their use.
Our Privacy Policy explains how we handle information and is part of these Terms.

1. The Service
LawnClock helps lawn, landscape and similar service businesses:
- record when workers arrive at and leave job sites, using the location features of the worker's phone;
- review hours, visits and labor cost;
- schedule visits and plan routes;
- prepare quotes, invoices and statements and share them with customers, and give customers a portal to see them;
- take card and bank payments from customers through the Company's own Stripe account.
LawnClock is a record-keeping and communication tool. It is not a payroll service, a bank or a payment processor (Stripe processes payments), or legal, tax or accounting advice.
2. Accounts and users
- You must be at least 18 and able to form a binding contract to open a Company account. Give us accurate information and keep it up to date.
- You control who has access to your account. Owners and admins can add workers and other admins. You're responsible for everything done under your account, and for making sure your users follow these Terms.
- Keep passwords confidential. Tell us right away at [email protected] if you think your account has been accessed without permission.
- Accounts are for one business. Don't share a login between people.
3. Free trial, plans and fees
- New Companies get a free trial. Its length and limits (such as the number of users and job sites) are shown at sign-up. Importing your records works during the trial; exporting files comes with paid plans, not the trial.
- One free trial per business. If the same business signs up again for another free trial, we may end the new trial early and ask you to pick a plan.
- To keep using the Service after the trial, you'll need a paid plan at the price shown to you when you choose it. We won't charge you unless you've agreed to a paid plan.
- Paid plans renew automatically for the same period until cancelled. Fees are charged in advance and, unless the law requires otherwise, aren't refundable for partial periods. Prices don't include taxes, which you are responsible for.
- We may change prices for future periods. We'll give you at least 30 days' notice, and you can cancel before the change takes effect.
- If a payment fails and isn't fixed after we notify you, we may suspend the account until it is.
- Add-ons (such as the Equipment Service Log, Property Measure, Our Game Plans and Card & bank payments) are separate subscriptions, at the price and billing period shown when you add one. Some are included free with some plans, or for a time. A paid add-on is charged by card through Stripe, renews automatically for the same period until you cancel it, and if you cancel it keeps working until the end of the period already paid for. If a renewal payment can't be collected, or your plan no longer includes it, the add-on is switched off. Your records are kept.
- When an add-on we include free is later offered at a price, we'll give you at least 30 days' notice before you'd be charged, and nothing is charged unless you add it.
4. Your responsibilities for workers and location data
The mobile app uses a worker's phone location, including in the background, to detect arrivals at and departures from assigned job sites. You, not LawnClock, decide to monitor your workers this way. So you agree that:
- You'll tell workers about the location logging before they use it. That includes what is recorded, when, and why. You'll get any written notice, acknowledgment or consent the law requires. Some states require advance written notice of electronic monitoring; New York Civil Rights Law §52-c is one example.
- You'll use location and time records only for legitimate business purposes, such as time keeping, job verification, billing and safety. You won't use them to track anyone outside working time.
- You won't require a worker to install the app on a personal phone where the law doesn't allow it. You'll respect a worker's choice to turn logging off where the law gives them that choice.
- You're responsible for paying your workers correctly. That means following wage-and-hour, overtime, break and record-keeping laws, and reviewing records before relying on them. Phone location can be wrong, late or missing: GPS limits, phone battery settings, no signal, permissions turned off, or a phone left behind can all cause gaps. Visits missing a departure are flagged for review. Time records should be checked, and corrected when needed.
- If you add workers under 18, you're responsible for any parental consent or other rules that apply to them.
Text messages. Workers can choose to get texts about urgent jobs you pick them for, and when automatic logging is off on their phone during their work hours (LawnClock crew alerts, sent by CostingPlus.com Inc.). Only the worker can sign up, in their own Settings, by ticking an unticked box; you can't sign them up or ask us to. Message frequency varies. You agree to use urgent jobs only for real work, never for marketing. Message and data rates may apply. Reply STOP to stop, HELP for help, or email [email protected] (716-714-9933). Carriers aren't liable for delayed or undelivered messages. Mobile information is never shared or sold to third parties for marketing. Details: Text messages and the Privacy Policy.
5. Quotes, invoices and payments
- Quotes and invoices are between you and your customers. You're responsible for their content, prices and taxes, and for following the law that applies to them. LawnClock fills in invoice lines from recorded visits and your price settings. Review every document before you send it.
- Your own payment link. If you add one, the "Pay now" button sends customers to the payment page you provide (for example PayPal, Square or your bank). Changing it asks for your password, and we email you about the change. We don't process, hold or guarantee those payments, we aren't a party to them, and we aren't responsible for that provider.
- Card and bank payments through Stripe. If you connect a Stripe account, your customers pay you on Stripe's own pages, and the money goes to your Stripe account and on to your bank. You open that account with Stripe and agree to Stripe's own terms (the Stripe Services Agreement); the account is yours, and Stripe, not us, processes and holds the money and decides whether to accept your account. We never see or keep card or bank numbers.
- Fees. Stripe's own fees come out of each payment, under your agreement with Stripe. We also charge the platform fee per payment shown in Settings when you connect (a percentage of card and of bank payments), which Stripe takes from the payment and passes to us. We may change the platform fee for future payments with at least 30 days' notice. When a payment is refunded, or a dispute is lost, the platform fee on that part is given back to you; Stripe's own fees follow Stripe's rules.
- Refunds and disputes are between you, your customer and Stripe: you make refunds in your Stripe Dashboard, and a customer's bank dispute (chargeback) is handled by Stripe with you. LawnClock records what Stripe tells it on the invoice and emails you, but we aren't a party to the payment.
- Autopay. Your customers can turn on autopay themselves, in the customer portal, only after agreeing to it; their card is kept by Stripe in your account and charged on each invoice's due date. Only the customer turns it on, and you or they can turn it off at any time. You're responsible for honoring what they agreed to, and for telling them about any change to how or when you bill them.
- The customer portal. If you turn it on, your customers sign in with the email on their customer record (we email them a link) and see their own invoices, quotes, visits and job photos, ask for service, and update their phone and address. You're responsible for keeping their email addresses right, since that's how they sign in, and for what you show them.
- Statements you email to customers show their invoices, payments and balance as recorded in LawnClock. Check them before you send them.
- Emails sent by LawnClock on your behalf show your company name and route replies to your billing email. You'll only send quotes and invoices to people you do business with, and you'll follow anti-spam laws. When you use Send from my email, or connect your own Gmail or Outlook mailbox so LawnClock sends through it, the message goes out from your own email account under your provider's terms and sending limits, and you're responsible for having the right to send from that mailbox. If your mailbox refuses a message, LawnClock may send it from its own address instead so it still arrives.
- Invoice and quote links let anyone who has the link view that document. Share them only with the intended customer.
- Emailing your customers in bulk (news and offers): you'll send only to your own customers who would expect to hear from you, never to bought or rented lists, and you'll follow the CAN-SPAM Act and any other law that applies, including honest subject lines and identifying the message as an ad where required. LawnClock adds your business address and an unsubscribe link to each one and stops sending to anyone who unsubscribes; don't add them back. Your plan includes a number of these emails each month. We may pause bulk email for a Company whose emails draw complaints or bounce a lot.
- Payroll hours, job profit and the accountant's reports (profit & loss, sales tax) are worked out from the visits, invoices, purchases and pay rates in LawnClock. They're guides, not payroll, tax filings or accounting advice: check them, and ask your accountant or payroll provider before you rely on them.
- Hire and leave records, and injury and damage reports are kept for your convenience. They aren't payroll, workers' compensation, OSHA or insurance filings, and LawnClock doesn't send them anywhere. You're responsible for what the law requires you to report, keep and protect, including keeping injury information private.
- Chemical application records are kept for your convenience. You're responsible for what your state requires you to record, report and keep, and for checking the records and the CSV before you hand them in.
6. Your data
- You own the information you and your users put into the Service, including worker, job site, customer, time, quote and invoice records ("Your Data").
- You give us permission to host, copy, process and display Your Data only as needed to provide, secure and support the Service, as described in our Privacy Policy. We don't sell Your Data.
- You're responsible for having the rights and permissions needed for Your Data, including customer contact details and worker information.
- You can export your timesheets as CSV at any time. We keep regular backups, but you should keep your own copies of anything you need for payroll, tax or legal records.
- We may use anonymized, aggregated information that doesn't identify you, your users or your customers to run and improve the Service.
7. Acceptable use
You won't, and won't let anyone else:
- use the Service to break any law, or to track, stalk or harass anyone;
- record the location of anyone who isn't your worker, or who hasn't been properly notified;
- send spam, or fraudulent or misleading quotes or invoices;
- try to get into another Company's data, test or bypass our security, or overload the Service;
- copy, resell, reverse engineer or build a competing product from the Service, except as the law expressly allows;
- upload malicious code or content that infringes someone else's rights.
8. Availability and changes
We work to keep LawnClock running and secure, but we don't promise it will always be available or error-free. Maintenance, outages at our hosting, network or email providers, and phone operating system changes can all interrupt it. We may add, change or remove features. If we remove a major feature you pay for, we'll tell you in advance when we reasonably can.
9. Our intellectual property
We own the Service, including its software, design and the LawnClock name and logo. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your internal business while your account is in good standing. If you send us suggestions, we may use them without any obligation to you.
10. Cancellation and termination
- You can cancel at any time from Settings → Your subscription, or by emailing [email protected] from the owner account. Cancellation takes effect at the end of the current paid period.
- We may suspend or end your access if you seriously or repeatedly break these Terms, don't pay, or if we must do so to comply with the law or protect the Service or others. Where it's reasonable, we'll warn you first and give you a chance to fix the problem.
- When your account closes (or you disconnect Stripe), card and bank payments and autopay stop, and invoices go back to your own payment link and instructions. Your Stripe account stays yours, with its payment history, under your agreement with Stripe.
- After an account closes, you can ask for a CSV export of your timesheets within 30 days. After that, we delete Your Data as described in the Privacy Policy.
- Sections 4 through 7 and 9 through 15 survive the end of these Terms, to the extent they apply.
11. Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that location detection, time records, routes, drive-time estimates, schedules or invoice amounts will be accurate or complete. You're responsible for reviewing them before you rely on them.
12. Limitation of liability
To the fullest extent the law allows:
- Neither we nor our suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, wages, data or goodwill, even if we were told they were possible.
- Our total liability for all claims relating to the Service or these Terms is limited to the greater of the fees you paid us for the Service in the 12 months before the claim arose, or US $100.
These limits don't apply where the law doesn't allow them.
13. Indemnity
You'll defend and indemnify CostingPlus.com Inc. and its officers and employees against third-party claims, and the resulting losses and reasonable legal fees, that arise from:
- Your Data;
- your use of the Service in breach of these Terms or the law;
- your monitoring of workers, including any failure to give notice or obtain consent;
- your pay practices;
- your quotes, invoices and dealings with your customers.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Erie County, New York, and both parties consent to those courts' jurisdiction. Before filing a claim, each party agrees to try to resolve the dispute informally, by contacting the other and allowing 30 days to work it out.
15. General
- Changes to these Terms: We may update these Terms. We'll post the new version with a new effective date. For significant changes, we'll notify Company owners at least 30 days before they take effect. Continuing to use the Service after that means you accept the changes.
- Assignment: You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
- Events outside our control: We're not responsible for delays or failures caused by events outside our reasonable control.
- Other terms: If any part of these Terms can't be enforced, the rest stays in effect. Not enforcing a term isn't a waiver of it. These Terms and the Privacy Policy are the entire agreement between us about the Service.
- App stores: If you downloaded the app from Apple's App Store, you acknowledge that these Terms are between you and us, not Apple. Apple has no obligation to support the app and isn't responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the app.
